These Terms and Conditions ("Terms") govern your access to and use of The Outspoken Digest (the "Site"), operated by AVMDEVS LLC (the "Operator", "we", "us", "our"). By accessing or using the Site you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
About the Site
The Outspoken Digest is an independent editorial e-magazine that publishes journalism, features and commentary across a range of subjects. The Site is provided for general information and reading. It does not provide professional advice, and it does not create any professional or advisory relationship between you and us.
Eligibility
You may use the Site only if you can form a legally binding contract with us and are not barred from doing so under applicable law. The Site is intended for a general, adult audience and is not directed to children under 16.
Intellectual property
All content on the Site, including articles, text, headlines, photographs, illustrations, logos, and the design and arrangement of the Site, is owned by the Operator or its licensors and is protected by intellectual property laws. Photographs and other third-party materials are used under licence and remain the property of their respective owners, who are credited where applicable.
You are granted a limited, personal, non-exclusive, non-transferable licence to access and read the Site for your own non-commercial use. You may share links to our articles. You may not otherwise copy, reproduce, republish, scrape, sell, distribute, or create derivative works from our content, or use it to train machine-learning systems, without our prior written permission. Brief quotation with clear attribution and a link, for the purposes of commentary or review, is permitted where the law allows.
Acceptable use
When using the Site, you agree not to:
- Use it for any unlawful purpose, or in breach of these Terms.
- Attempt to gain unauthorised access to the Site, its servers, or any connected systems.
- Interfere with or disrupt the Site, for example through excessive automated requests, scraping, or denial-of-service activity.
- Introduce malware or any harmful code.
- Misrepresent your identity, or use the contact form to send spam, unlawful, defamatory, harassing or infringing material.
- Remove or obscure any copyright, credit or proprietary notices.
Submissions and correspondence
If you send us an enquiry, tip, feedback or other material through the contact form or by email, you confirm it is yours to send and does not infringe anyone's rights, and you grant us a non-exclusive, royalty-free licence to use it for the purpose of responding to you and operating the Site. Please do not send confidential information you do not want us to have. How we handle the personal information in your message is described in our Privacy Policy.
Editorial content and no professional advice
Our journalism is researched and written in good faith, but it is provided for general information only and may become out of date. Nothing on the Site is professional advice.
In particular, articles about diving, freediving, health, nutrition, recipes, safety, travel, finance or similar subjects are journalism, not instruction. They are not a substitute for qualified, individualised guidance. For example, diving and freediving are hazardous activities that must be learned and practised only under a certified instructor and agency; nothing on the Site is a training manual, a dive plan, or medical, legal, financial or safety advice. Always seek appropriately qualified professional advice before acting, and never rely on the Site where your health or safety is at stake.
Third-party links and advertising
The Site links to third-party websites and sources, and carries advertising that helps fund the publication. We do not control, and are not responsible for, the content, products, services or practices of third parties, and a link or advertisement is not an endorsement. Your dealings with third parties are solely between you and them.
Availability
We aim to keep the Site available, but we do not guarantee that it will be uninterrupted, secure or error-free. We may change, suspend, or discontinue any part of the Site, including any article, at any time and without notice.
Disclaimers
The Site and all content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the content is accurate, complete, current or reliable.
Limitation of liability
To the fullest extent permitted by law, the Operator and its officers, employees and contributors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of, or inability to use, the Site or its content, whether based in contract, tort, or otherwise, even if we have been advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.
Indemnification
You agree to indemnify and hold harmless the Operator and its officers, employees and contributors from any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of your misuse of the Site or your breach of these Terms.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes will be made prominent on the Site. Your continued use of the Site after an update means you accept the revised Terms.
Governing law
These Terms are governed by the laws applicable where the Operator is established, without regard to conflict-of-laws principles, and the courts of that jurisdiction will have jurisdiction over any dispute, subject to any mandatory consumer-protection rights available to you under the law of your country of residence.
General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site.
